§ 1 Scope / Providers / Merchants
These general terms and conditions of business apply to all orders placed on the online shop of WITAL GmbH.

§ 2 Contract Language and Conclusion of Contract
Personal data is information of any kind which allows a person to be identified. This definition includes all details which can be traced back to a person. This includes names, email addresses, or phone numbers. It also encompasses personal data about preferences, hobbies, memberships, or which web pages were viewed by someone. Personal data is only collected, used, and passed on by the provider if permitted by law, or if the user gives their consent.
§ 3 Prices and Shipping Costs
All prices quoted in the online shop include the statutory VAT in Germany. Shipping costs are not included.
For details of shipping costs, please refer to the relevant tables. Total shipping costs will also be indicated next to the purchase price before an order is finalized.
§ 4 Payment
WITAL GmbH (Number of organic certificate: DE-HE-039-05889-BCD-2021-V1) accepts the following forms of payment:
You can pay for your order using PayPal. If you choose to pay using PayPal, you will be automatically redirected to the PayPal website. Here you can log in with your PayPal account details in order to carry out the transaction. Depending on your preferred payment method on PayPal, you will settle the amount using existing credit, a direct debit, a credit card, or Giropay. If you do not have a PayPal account, you can set one up by visiting the PayPal website.
• Advance Payment
You can also settle your order by making advance payment. In this case, you pay for the order using the bank account details stated in the order confirmation and we shall deliver the goods after receiving the payment.
§ 5 Right to cancellation
You are entitled to cancel this contract without stating a reason for a cooling-off period of 14 days.
The cooling-off period shall end 14 days from the date on which you or a designated third party other than the carrier takes possession of the goods.

You can use the attached sample cancellation form, but this is not a requirement. You can also complete and submit the sample cancellation form or other proforma statements in electronic format on our website (www.witaltea.com). If you use this option, we will immediately send confirmation that your cancellation request has been received (e.g. by email).
In order to ensure that the cancellation takes place, it is sufficient to inform the provider of your intention to exercise your right to cancellation before the end of the cancellation period.
Consequences of Cancellation
If you cancel this contract, we shall reimburse all the payments we have received from you, including shipping costs (except for additional costs incurred as a result of your choosing a different type of delivery than the most affordable standard delivery option we offer). This obligation shall be fulfilled without delay and no later than 14 days from the date on which we received notification of your intention to cancel the contract. When repayments are made, we shall use the same payment method as the original transaction unless a specific agreement has been made with you. Under no circumstances will you be charged a fee for repayment. We may however postpone repayment until we have received the goods or until you provide proof that you returned the goods — whichever is earlier.

The cooling-off deadline shall be met if you dispatch the goods before the end of the 14-day period.
You are required to pay the immediate costs of returning the goods.
You shall only be liable for the diminished value of the goods if this results from handling in a manner that is not necessary to ascertain the properties, characteristics, and functioning of the goods.

§ 7 Delivery
Unless agreed otherwise, the goods shall be delivered to the address you specified when ordering.
Shipment to an alternative address is only possible to countries listed in the shipping cost overview. For more information, please refer to the relevant tables.
§ 8 Reservation of Title
WITAL GmbH (Number of organic certificate: DE-HE-039-05889-BCD-2020-V1) reserves the title to the goods until payment has been made in full.
§ 9 Guarantee
The statutory provisions shall apply with respect to guarantee law.
§ 10 Liability
WITAL GmbH (Number of organic certificate: DE-HE-039-05889-BCD-2021-V1) is liable under statutory provisions.
Liability for culpable injury to life, limb, or health and obligations under the German Product Liability Act remains unaffected.
§ 11 Applicable Law
The law of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.
If a purchase contract is concluded that cannot be attributed to the professional or commercial activities of the customer (consumer contract), the statutory provisions of the state where the ordering party is normally resident shall also apply.
§ 12 Final Provisions
These general terms and conditions of business can be accessed by anyone via the online shop of WITAL GmbH ( www.witaltea.com, Number of organic certificate: DE-HE-039-05889-BCD-2021-V1), and they may be printed out and/or saved.
Should any provision of these terms and conditions be or become invalid, all other provisions shall remain valid.
